These General Terms and Conditions apply to contracts for the purchase of goods concluded by consumers through our online shop.
A consumer is a person who enters into a legal transaction for purposes predominantly outside their trade, business or independent professional activity.
The Terms and Conditions made available and validly agreed upon at the time of ordering shall apply. Mandatory statutory consumer rights remain unaffected.
2. Products and Conclusion of Contract
The presentation of products in our online shop does not constitute a legally binding offer but an invitation to customers to place an order.
By clicking the appropriately labelled button to complete the checkout process, the customer submits a binding offer to purchase the selected goods.
After receiving an order, we send an automatic order confirmation by email. This confirmation acknowledges receipt of the order and does not yet constitute acceptance of the customer's offer.
A purchase contract is concluded when we confirm dispatch of the ordered goods by email or actually dispatch the goods.
If an order cannot be accepted, we will inform the customer without undue delay. Any payments already collected will be refunded without undue delay using the original payment method.
The checkout process and contractual information are provided in German and, where available in the shop, in English. The language version used for the respective order shall apply, subject to mandatory statutory provisions.
3. Product Descriptions and Availability
We make every effort to describe and display our products as accurately as possible.
Minor differences in colour between product images and delivered goods may occur due to individual screen settings. Statutory rights relating to goods that do not conform to the contract remain unaffected.
Some of our products are unique pieces, vintage items or originate from previous collections. Availability may therefore be limited. For second-hand goods, known signs of wear and characteristics material to the purchasing decision are stated in the product description.
If an ordered item is unavailable, we will inform the customer without undue delay. There is no obligation to supply a substitute product. Statutory rights remain unaffected.
4. Prices and Payment
The prices displayed in the online shop at the time of ordering shall apply.
Prices include applicable VAT where required by law.
Any additional shipping charges will be displayed separately before the order is completed.
Available payment methods are shown during checkout. Only the payment methods offered there may be used.
Payments are processed through the payment service providers indicated during checkout.
For deliveries to countries outside the European Union, additional import duties, taxes and customs charges may apply. Unless expressly indicated as included in the total price at checkout, such charges must be paid by the recipient in accordance with applicable law. Mandatory statutory information obligations remain unaffected.
5. Delivery and Shipping
We deliver to the countries available for selection in our online shop.
The shipping charges and delivery conditions applicable to each order are displayed before checkout is completed.
Estimated delivery times are provided in the online shop or in the relevant product information.
Unless a different delivery period has been agreed, goods will be delivered without undue delay and no later than 30 days after conclusion of the contract.
Custom-made products may require different delivery times. Any such delivery periods will be communicated before the order is placed.
If a delivery is delayed, we will inform the customer as soon as we become aware of the delay. The customer's statutory rights in the event of delayed delivery remain unaffected.
In consumer transactions, the risk of loss of or damage to goods generally passes to the consumer only when the goods are delivered to the consumer or to a third party designated by the consumer who is not the carrier. Statutory exceptions remain unaffected.
6. Retention of Title
The goods remain our property until the purchase price has been paid in full.
7. Statutory Warranty Rights
All goods purchased through our online shop are covered by the applicable statutory warranty rights.
If goods are defective or do not conform to the contract, consumers are entitled to the remedies provided by law, including repair or replacement and, where the statutory requirements are met, a price reduction or termination of the contract.
The statutory warranty period for movable goods is generally two years from delivery. Special statutory provisions apply to second-hand goods. These Terms and Conditions do not provide for any reduction of the statutory warranty period.
Consumers are not required to inspect goods immediately upon delivery or report defects without delay in order to preserve their statutory warranty rights.
These Terms and Conditions do not exclude or restrict any statutory warranty rights.
Any voluntary manufacturer's or seller's guarantee applies in addition to statutory warranty rights and does not limit them.
8. Right of Withdrawal
Consumers generally have the right to withdraw from a distance contract within 14 days without giving any reason.
The withdrawal period generally begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, receives the goods. Where goods from a single order are delivered separately, the period begins upon receipt of the last item.
To exercise the right of withdrawal, the consumer must inform us of their decision to withdraw by means of a clear statement.
This statement may be submitted, for example, by email to contact@domusvivendi.store or through the online withdrawal function provided on our website. Use of the online function is not mandatory; other legally permitted methods of withdrawal remain available.
Further details regarding the right of withdrawal, its consequences and statutory exceptions are set out in our separate Withdrawal Instructions, which form part of the pre-contractual consumer information.
9. Returns
Following a valid withdrawal, goods must be returned or handed over without undue delay and no later than 14 days after the consumer has communicated their decision to withdraw.
Returns should be sent to:
DOMUS VIVENDI FASHION GmbH
Westbahnstraße 5a
1070 Vienna
Austria
The consumer bears the direct cost of returning the goods, provided they have been properly informed of this before concluding the contract. Statutory exceptions remain unaffected.
Goods may also be returned in person to our physical store.
In the event of a valid withdrawal, we will refund all payments required by law, including the cost of the least expensive standard delivery option offered by us, without undue delay and no later than 14 days after receiving the withdrawal notification. In accordance with applicable law, we may withhold reimbursement until we have received the goods or the consumer has supplied evidence of having sent them back.
We will generally use the same payment method as for the original transaction, unless expressly agreed otherwise. No fees will be charged for reimbursement.
The consumer is liable for any diminished value of the goods only if it results from handling beyond what is necessary to establish their nature, characteristics and functioning.
10. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply, in particular, to goods made to the consumer's specifications or clearly personalised to meet the consumer's individual requirements.
Other statutory exceptions apply only where the relevant legal requirements are met, including sealed goods that are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery.
The mere fact that an item is unique, vintage, discounted or from a previous collection does not exclude the statutory right of withdrawal.
11. Privacy and Data Protection
Information about the processing of personal data is provided in our separate Privacy Policy, available through the “Privacy Policy” or “Datenschutz” link in our online shop.
12. Applicable Law and Jurisdiction
Austrian law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers habitually resident in another country, this choice of law does not deprive them of the protection afforded by mandatory consumer protection provisions that cannot be excluded by agreement under applicable international private law.
Any disputes shall be subject to the applicable statutory rules on jurisdiction, including the special jurisdictional protections available to consumers.
13. Final Provisions
If any provision of these Terms and Conditions is or becomes invalid, the remaining provisions shall remain unaffected. The applicable statutory provisions shall apply in place of any invalid provision.
Mandatory statutory consumer rights remain unaffected.
